4 By accessing or using the Site or otherwise indicating your consent, you agree to be bound by these Terms and the documents referred to in them.

has the meaning given to it in the section entitled “submitting information to the site”

B Using the Site
1 The Site is for your personal and non-exclusive use only. As long as you comply with these Terms of Use Julia Hart grants you a personal, non-exclusive, non-transferable, limited privilege to enter and use the Site.
2 You may not use any “page-scraper”, “robot”, “spider”, “deep-link” or other automatic device, program, algorithm or methodology, or any similar or equivalent manual process, to access, copy, acquire, or monitor any part of the Site, or in any way reproduce or circumvent the navigational structure or presentation of the Site or any Content, to obtain or attempt to obtain any materials, documents or information through any means not purposely made available through the Site.

10 The Site is intended for use only by those who can access it from within the UK. If you choose to access the Site from locations outside the UK, you are responsible for compliance with local laws where they are applicable.
11 You agree that you are solely responsible for:
(i) all costs and expenses you may incur in relation to your use of the Site; and
(ii) keeping your password and any other account details confidential.

C Ownership, use and intellectual property rights
1 This Site and all intellectual property rights in it, including but not limited to any Content, are owned by us, our licensors or both (as applicable). We and our licensors reserve all of our and their rights in any intellectual property in connection with these Terms. This means, for example, that we and they remain owners of them and free to use them as we and they see fit.
2 Nothing in these Terms grants you any legal rights in the Site other than as necessary to enable you to lawfully access the Site as intended and authorized by us. You agree not to adjust to try to circumvent or delete any notices contained on the Site (including any intellectual property notices) and in particular in any digital rights or other security technology embedded or contained within the Site.
D Submitting information to the Site
1 While we try to make sure that the Site is secure, we cannot guarantee the security of any information that you supply to us. We therefore cannot guarantee that it will be kept confidential. For that reason, you should not submit any patentable ideas or patent applications, advertising or marketing suggestions, prototypes, or any other information that you regard as confidential, commercially sensitive or valuable (Unwanted Submissions) to the Site. While we value your feedback, you agree not to submit any Unwanted Submissions.
2 We may use any Unwanted Submissions as we see reasonably fit on a free-of-charge basis (bear in mind that we have no way of knowing whether such information is confidential, commercially sensitive or valuable because we do not monitor the Site to check for these matters). Therefore, we will not be legally responsible for keeping any Unwanted Submissions confidential nor will we be legally responsible to you or anybody else for any use of such Unwanted Submissions.
E Accuracy of information and availability of the Site
1 While we try to make sure that the Site is accurate, up-to-date and free from bugs, we cannot guarantee that it will be. Furthermore, we cannot guarantee that the Site will be fit or suitable for any purpose. Any reliance that you may place on the information on this Site is at your own risk.
2 We may suspend or terminate operation of the Site at any time as we see fit.
3 You may have certain legal rights when using the Site (such as if the Online terms and conditions for the supply of goods apply to you). These are also known as ‘statutory rights’ as they are derived from laws such as the Consumer Rights Act 2015. 5 While we try to make sure that the Site is available for your use, we do not promise that the Site is available at all times nor do we promise the uninterrupted use by you of the Site.

The Site may contain hyperlinks or references to third party websites other than the Site. Any such hyperlinks or references are provided for your convenience only. We have no control over third party websites and accept no legal responsibility for any content, material or information contained in them. The display of any hyperlink and reference to any third party website does not mean that we endorse that third party’s website, products or services. Your use of a third party site may be governed by the terms and conditions of that third party site.
G Limitation on our liability
Except for any legal responsibility that we cannot exclude in law (such as for death or personal injury), we are not legally responsible for any losses. This exclusion shall include, but not be limited to:
(a) losses that:
- were not foreseeable to you and us when these Terms were formed; or
- that were not caused by any breach on our part
(b) business losses; and
(c) losses to non-consumers.
H Events beyond our control
We shall have no liability to you for any breach of these Terms caused by any event or circumstance beyond our reasonable control including, but not limited to, strikes, lock-outs or other industrial disputes; breakdown of systems or network access; or flood, fire, explosion or accident.
I Rights of third parties
No one other than a party to these Terms has any right to enforce any of these Terms.
J Disputes
1 We will try to resolve any disputes with you quickly and efficiently.
2 If you are unhappy with us please contact us as soon as possible.
3 If you and we cannot resolve a dispute using our complaint handling procedure, we will:
(a) let you know that we cannot settle the dispute with you; and
(b) consider the need for Alternative Dispute Resolution and, if considered necessary, provide you with information about any alternative dispute resolution provider we deem appropriate to deal with your complaint.
4 If you want to take court proceedings, the relevant courts of the United Kingdom will have exclusive jurisdiction in relation to these Terms.
5 Relevant United Kingdom law will apply to these Terms.
Online terms and conditions of sale
means the terms and conditions www.juliahart.co.uk, which will apply to you ordering goods, services and/or digital content using the Site;
Julia Hart permits you to purchase products made available to you on this Site. These purchases can be made and are permitted strictly pursuant to the terms and conditions set out below.
Your purchase order cannot be accepted until payment in full for the products ordered has been received by us at which time a legally binding agreement on the terms set out herein will become effective.
You may purchase products on the Site only for personal use and not for resale. By placing your order, you certify that you are purchasing products for personal use only and not for resale and you accept our General Terms and Conditions of Sale. Julia Hart RESERVES THE RIGHT TO REFUSE ORDERS FOR ANY REASON WITHOUT EXPLANATION.
All credit/debit cardholders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses or does not for any reason, authorise payment to us, whether in advance or subsequent to a payment, or alerts us to a ‘warning that this transaction has been identified as potentially high risk’, we will not be liable for any delay or non-delivery.
All purchases are subject to bank authorisation prior to processing. Only authorised purchases may be processed and delivered. We may at our discretion on occasions ask you to pay by bank transfer. In which case we will refund any card payments that may have been put through, FOR ANY REASON WITHOUT EXPLANATION. And we will not be liable for any delay even in instances where Next Day Special Delivery had been arranged or paid for.
Skincare Products online purchase Price & Payment
The price to be paid by you for any Products will be as quoted on our Site except in cases of obvious error.
Our prices include VAT
Postage Terms and prices are:
UK orders under £80 – £4.00
Sent by Royal Mail signed for service
UK orders £80 and over – Free postage, Royal Mail or DPD local
International orders
Sent by Royal Mail Tracked & Signed
EU Countries – Flat rate £8.50 between 5 – 10 days
We will do our best to deliver your order in accordance with the delivery periods, unless there are exceptional circumstances. Delivery periods include Monday to Friday – Orders after 12pm on Fridays will be despatched on Monday. We can not take any responsibility for delayed orders to other countries outside the UK due to individual custom regulations. We do not ship internationally at present.
We do not accept any liability whatsoever for delayed delivery caused by any third parties. This includes delivery address errors, it is the buyers responsibility to ensure the correct delivery details are present at the time of purchasing the goods.
Parcel Returns
Parcels will be charged to be ‘resent’ if they are returned to Julia Hart due to:
- a) Incorrect delivery address or delivery information (safe place); or b) Not collected from parcel office if not in at time of delivery
Upon delivery of the Products to you, we will also provide you with sufficient details to enable you to a) exercise your right of cancellation; and b) address any intended cancellation or complaints to the correct place.
Skincare Products online purchase Ownership
Ownership of the Products will only pass to you when we receive full payment of all sums due in respect of the products, including delivery charges.
Skincare Products online purchase Returns Policy
We do hope that you will be happy with your purchase. However, if for some reason you would like to return any product bought from Julia Hart, we will be happy to refund or exchange it provided that the product together with its packaging is in fully re-saleable condition. Returns must be made within 14 days of delivery to you and in original, undamaged and unopened packaging. We will not refund postage and it is your responsibility to arrange and pay for the return of any Product. This does not affect your statutory rights.
All returns should be sent via Recorded Delivery, as we cannot be responsible for any items that are lost in transit. You must also retain proof of postage.
To return a Product please send it back securely wrapped, in the original protective packaging along with a completed Returns Note stating the reason for your return to the following address:

If your order arrives and the products are not what you ordered, or the order is incomplete, or any product is in a damaged condition when you receive it, please notify us immediately by email: info@juliahart.co.uk
In the case of damaged goods please retain all packaging and damaged products for our inspection. Please take and send Julia Hart pictures of the damage. Subject to this information provided and to these Terms and Conditions we will within a reasonable time refund the price you paid for the returned products together with the initial delivery charge. Please state clearly your dispatch details in all communications to us.
Julia Hart will only make a refund via the payment method used for the online purchase. Legal ownership of the goods will immediately revert to us if we refund any such payment to you.
Julia Hart will not accept the return of products which have been purchased from any outlet other than our online shop. Therefore you will have to provide your order invoice number. The provisions of this clause do not affect your statutory rights.
OUR RIGHT TO VARY THESE TERMS AND CONDITIONS
Julia Hart have the right to revise and amend these Terms and Conditions from time to time, for example, to reflect changes in market conditions affecting our business, changes in technology, changes in payment methods, changes in relevant laws and regulatory requirements and changes in our system’s capabilities.
You will be subject to the policies and Terms and Conditions in force at the time that you order Products from us, unless any change to those policies or these Terms and Conditions is required to be made by law or governmental authority (in which case it will apply to orders previously placed by you), or if we notify you of the change to those policies or these Terms and Conditions before we send you the invoice (in which case we have the right to assume that you have accepted the change to the Terms and Conditions)
